NRI Alert: Keeping a Resident Savings Account in India Can Cost You Lakhs in Penalties

If you are an NRI, or if someone in your family is an NRI, this information can literally save you from penalties running into lakhs of rupees.

Here’s the simple truth many NRIs miss:

The moment your residential status changes from Resident to Non-Resident, your old Resident Savings Bank Account becomes a violation under FEMA. You are required to convert it into an NRO Account. Banks usually do not remind you. The responsibility is entirely yours.

What Is FEMA?

FEMA stands for the Foreign Exchange Management Act, 1999.

It is the main Indian law that regulates all foreign exchange transactions, cross-border money movements, and the banking, investment, and property dealings of NRIs and foreign residents in India.

In simple words, FEMA lays down the rules for:

  • How NRIs should maintain bank accounts in India
  • What kind of accounts they can hold (NRE, NRO, FCNR, etc.)
  • Restrictions and permissions related to sending money in and out of India
  • Compliance requirements for investments, property, and other financial assets

When an Indian resident becomes an NRI, FEMA requires that all existing resident bank accounts be converted into the appropriate non-resident category (usually NRO). Continuing to operate a Resident Savings Account after the status change is treated as a FEMA violation.

What Exactly Is an NRO Account?

NRO stands for Non-Resident Ordinary Account.

It is the account designed for NRIs to hold income earned in India – such as rent, dividends, pension, interest, or sale proceeds from property. You can maintain it as a savings, current, recurring deposit, or fixed deposit account.

How Serious Is the Penalty?

Under Section 13 of FEMA, if you continue to keep a Resident Account after becoming an NRI:

  • If the amount in the account can be determined, the penalty can be up to three times that amount.
(Example: ₹5 lakh in the account → penalty up to ₹15 lakh)
  • If the amount cannot be clearly determined, the penalty can go up to ₹2 lakh.
  • Even more dangerous: As long as the violation continues, an additional penalty of ₹5,000 per day can be levied.

In many cases, banks also freeze such accounts once they discover the status has not been updated.

A small oversight can therefore turn into a very expensive problem.

How to Protect Yourself (Simple Steps)

The process is straightforward:

  1. Contact your bank and inform them that your residential status has changed to Non-Resident.
  2. Request conversion of your existing Resident Account into an NRO Account.
  3. Submit the documents the bank asks for. These commonly include:
    • Passport
    • Visa / Overseas residence proof
    • Overseas address proof
    • PAN
    • FEMA declaration

Exact requirements can vary slightly from bank to bank. In most cases, your account number remains the same – only the status changes. Some banks even allow this process through online banking.

The sooner you complete this, the safer you are.

Don’t Stop at Just the Savings Account

Once you become an NRI, review the status of all your Indian banking products:

  • Fixed Deposits
  • Recurring Deposits
  • Other savings or current accounts

RBI rules allow NRO accounts to be maintained in savings, current, RD, and FD forms.

Also check related products such as:

  • Demat accounts
  • Mutual funds
  • PPF
  • Insurance policies
  • Loans
  • Any other Indian investments

Each of these may have separate NRI/FEMA documentation requirements. It is always better to review them product by product.

Final Advice

A small delay or lack of awareness can cost you ₹2 lakh or even much more in penalties, plus daily charges and possible account freezing.

Check the status of your bank accounts today. Convert Resident accounts into NRO accounts without delay.
